OSTAAGAR Customer Terms & Conditions

These Terms of Service ("Terms") govern your access to and use of the Ostaagar mobile application and wholesale marketplace platform.

1. Acceptance of Terms

By creating an account or using the Ostaagar platform, you agree to be bound by these Terms and our Privacy Policy.

If you are using the platform on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Business Eligibility

Ostaagar operates as a B2B (Business-to-Business) marketplace platform. Access is restricted to legitimate business entities only.

  • Users must provide a valid GSTIN for tax compliance purposes.
  • Ostaagar reserves the right to verify business credentials before granting access to wholesale pricing and procurement services.
  • Misuse of trade pricing for individual retail consumption constitutes a violation of these Terms.

3. Ordering and Commercial Terms

  • Inventory: Product availability is subject to factory production, supplier operations, and real-time mill inventory status.
  • Pricing: All listed prices represent wholesale trade rates. Logistics fees, taxes, and GST are calculated during checkout.
  • Manifests: Once an order is placed, a purchase manifest is generated. Order cancellations are permitted only while the order remains in "Pending" or "Processing" status.
  • Payments: Ostaagar supports multiple payment methods including Online Payment and Cash on Delivery (COD). For COD orders, full payment must be completed immediately upon cargo arrival.

4. Logistics and Shipping

  • Consignments: Ostaagar acts as a facilitator for factory-direct logistics operations.
  • Delivery Timelines: Estimated delivery timelines are provided in good faith but are not guaranteed due to operational, production, or transportation variables.
  • Risk Transfer: Risk of loss passes to the buyer upon delivery of the consignment to the specified destination address.

5. Returns and Claims

  • Manufacturing Defects: Ostaagar provides a 7-day claim window for reporting manufacturing defects.
  • Damage Reporting: Damaged, missing, or incorrect items must be reported within 48 hours of delivery along with valid photographic evidence.
  • Return Conditions: Returned products must remain unused and in original factory packaging to qualify for return eligibility.
  • Final Sale Categories: Certain high-volume wholesale categories may be marked as non-returnable or final sale items.

6. Intellectual Property

All platform content, including trademarks, branding, UI/UX designs, software systems, and proprietary logistics technologies, are owned by Ostaagar Technologies Private Limited and protected under applicable laws.

7. Limitation of Liability

Ostaagar shall not be liable for indirect, incidental, special, or consequential damages arising from factory delays, manufacturing disruptions, logistics partner performance, or circumstances beyond reasonable control.

8. Governing Law

These Terms are governed by the laws of India. Any disputes arising from use of the platform shall be subject to the exclusive jurisdiction of the courts in the region of our registered office.
